This is a plain-English summary of the terms for using Chariform. Review it with your own adviser before relying on it.
1. Who we are
Chariform is a form builder for nonprofit organisations. These terms are a contract between Chariform ("we", "us") and the organisation that creates an account ("you"). By creating an account or using the service you accept these terms.
2. Your account
You are responsible for your account, the people you invite to it, and keeping access credentials safe. You must give accurate organisation details and tell us if you think your account has been accessed without permission.
Each account belongs to one organisation. Members of your organisation act on its behalf.
3. Acceptable use
You may use Chariform to build forms and collect submissions for lawful purposes. You must not use it to collect data you have no right to collect, to send spam, to break the law, or to attempt to disrupt or gain unauthorised access to the service or other customers' data.
You are responsible for the content of your forms and for telling the people who fill them in how their information will be used.
4. Your data
You own your forms and the submissions you collect. We store them so the service can work, and we process them on your instructions. For the personal data inside submissions, your organisation is the data controller and we act as a processor.
We do not sell your data or the data of the people who fill in your forms. We only share it with the services needed to run Chariform, such as our hosting and email providers, and with any CRM you choose to connect.
You can export your submissions at any time, and you can ask us to delete your data when you close your account.
5. Connecting a CRM
If you connect a CRM, you authorise us to send submission data to it on your behalf using the credentials you provide. Those credentials are encrypted. We are not responsible for how a connected CRM handles data once it has been sent there; that is governed by your agreement with that provider.
6. Plans, billing and cancellation
Paid plans are billed in advance, monthly or annually, through our payment provider. Your plan renews automatically until you cancel. You can change or cancel your plan at any time from the billing page; cancellation takes effect at the end of the current billing period and we do not refund part-used periods unless the law requires it.
If a payment fails we may limit access to paid features until it is resolved.
7. Availability and changes
We work to keep Chariform available and reliable, but we do not guarantee it will be uninterrupted or error free. We may update, add or remove features over time. If we make a material change to these terms we will let you know.
8. Liability
Chariform is provided on an "as is" basis. To the extent the law allows, we are not liable for indirect or consequential loss, or for loss of data you could have exported. Nothing in these terms limits liability that cannot be limited by law.
9. Ending the agreement
You can stop using Chariform and close your account at any time. We may suspend or close an account that breaks these terms. When an account closes we will, after a reasonable period, delete its data.
10. Governing law
These terms are governed by the laws of England and Wales, and the courts of England and Wales have jurisdiction.
